These Terms and Conditions ("Terms") govern the provision of services by Pick Fore Games, a company registered in the Republic of Ireland ("the Licensor"), and its website www.pickfore.com, relating to major golf tournament competitions, tailor-made and bespoke corporate events, radio SMS message competitions, golf club licences, and charities licensing. By engaging with our services, you ("the Client," "Participant," or "Licensee") agree to be bound by these Terms, which comply with the laws of the Republic of Ireland and the European Union.
1. Definitions
2. General Provisions
2.1. These Terms apply to all Services provided by
the Licensor. Additional terms specific to certain Services (e.g., SMS
competitions) may apply and will be communicated at the point of engagement.
2.2. The Licensor reserves the right to amend these Terms at any time.
Updated Terms will be posted on www.pickfore.com, and continued use of Services constitutes
acceptance of the revised Terms.
2.3. All Services are provided subject to compliance with Irish law,
including the Consumer Protection Act 2007, Gaming and Lotteries Act 1956 (as
amended), and EU regulations such as the Consumer Rights Directive
(2011/83/EU).
3. Major Golf Tournament Competitions
3.1. Eligibility: Participants must agree to games rules and terms.
3.2. Entry: Entry fees are non-refundable unless an event is cancelled by the Licensor. Fees will be clearly stated at the time of booking.
3.3. Rules: The Licensor's Tournament Director's decisions are final.
3.4. Prizes: Prizes are non-transferable and have no cash alternative
unless stated. Winners must attend prize presentations or forfeit their prize
unless prior arrangements are made.
3.5. Liability: The Licensor is not liable for personal injury, property
damage, or loss during events, except where caused by the Licensor's
negligence. Participants must have appropriate insurance.
3.6. Cancellation: If an event is cancelled due to unforeseen
circumstances (e.g., extreme weather), the Licensor will endeavour to reschedule
or refund entry fees, less reasonable administrative costs.
4. Tailor-Made and Bespoke Corporate Events
4.1. Booking: Corporate events require a written
agreement outlining the scope, costs, and deliverables. A non-refundable
deposit (typically 30%) may be required at booking, with the balance due no later
than 14 days before the event.
4.2. Customisation: The Licensor will design events based on Client
specifications. Any changes must be requested in writing at least 21 days
before the event, subject to feasibility and additional costs.
4.3. Cancellations by Client: Cancellations must be notified in writing.

5. Radio SMS Message Competitions
5.1. Operation: SMS competitions are operated under
the Gaming and Lotteries Act 1956 (as amended) and require a permit from the
relevant District Court in Ireland, where applicable.
5.2. Entry: Participants must be 18 or older and resident in the
Republic of Ireland. Standard network rates apply for SMS entries, and
Participants should check with their provider.
5.3. Prize Limits: Total prize value will not exceed €600 per event, or
€900 for a final event in a series, as per non-commercial gaming regulations.
5.4. Data Protection: Personal data (e.g., phone numbers) collected via
SMS entries will be processed in accordance with GDPR. Participants consent to
data use for competition administration and may opt out of marketing
communications.
5.5. Transparency: Winners will be selected randomly under independent
supervision. Results will be published on www.pickfore.com or announced on the relevant radio station.
5.6. Liability: The Licensor is not responsible for failed SMS deliveries
due to network issues or incorrect entries.
6. Golf Club Licences
6.1. Licence Agreement: Golf clubs wishing to use
Pick Fore Games' proprietary formats, software, or branding must enter a formal
licence agreement. Fees (where applicable) and terms will be specified in the agreement.
6.2. Use Restrictions: Licensees may not modify, reproduce, or
distribute licensed materials without prior written consent. Intellectual
property rights remain with the Licensor.
6.3. Compliance: Licensees must comply with the Copyright and Related
Rights Act 2000 and EU intellectual property laws (e.g., Directive 2001/29/EC).
6.4. Termination: The Licensor may terminate a licence with 30 days'
notice for breach of terms (e.g., unauthorised use). Licensees must cease use
of materials upon termination.
6.5. Support: The Licensor will provide reasonable support for licensed
services, subject to agreement terms.
7. Charities Licensing
7.1. Purpose: The Licensor may license formats or
services to charities for fundraising events will be discounted or without fees, subject to a written agreement.
7.2. Regulation: Charity events must comply with the Charities Act 2009
and Gaming and Lotteries Act 1956 (as amended). The Licensor will assist with
permit applications where required.
7.3. Fees: Licensing fees for specific charities may be discounted at the
Licensor's discretion. All fees will be transparent and agreed in advance.
7.4. Fundraising: The Licensor will ensure that funds raised are
allocated to the charity, less agreed costs (e.g., event organisation).
Third-party sales (e.g., refreshments) are not considered charitable proceeds.
7.5. Liability: The Licensor is not liable for charity event outcomes
unless caused by its negligence. Charities must ensure compliance with public
health and safety laws.
8. Data Protection
8.1. The Licensor processes personal data in
accordance with GDPR and the Data Protection Acts 1988–2018.
8.2. Purpose: Data is collected for event administration, competition
entry, licensing, and marketing (where consented).
8.3. Rights: Clients and Participants have the right to access, rectify,
or erase their data, subject to legal obligations. Requests should be sent to

8.4. Security: Data is stored securely on servers compliant with EU
standards. Third-party processors (e.g., payment gateways) are GDPR-compliant.
8.5. Retention: Data is retained only as long as necessary for the
purpose collected, typically no longer than 24 months post-event, unless
required by law.
9. Intellectual Property
9.1. All content on www.pickfore.com,
including tournament formats, logos, and software, is owned by or licensed to
the Licensor and protected by the Copyright and Related Rights Act 2000 and EU
law.
9.2. Clients, Participants, and Licensees may not use, copy, or
distribute intellectual property without written permission.
9.3. Tournament formats are not patentable under EU or Irish law (per
Patent Act 1992 and EU case law) but may be protected as trade secrets or
copyright where applicable.
10. Liability and Indemnity
10.1. The Licensor's liability is limited to three
times the cost of the Service provided, except in cases of death or personal
injury caused by negligence.
10.2. The Licensor is not liable for indirect losses, business losses,
or damages unforeseeable at the time of booking.
10.3. Clients and Licensees indemnify the Licensor against claims
arising from their misuse of Services or breach of these Terms.
11. Complaints and Dispute Resolution
11.1. Complaints should be submitted in writing to

respond within 28 days.
11.2. Disputes are subject to Irish law and the exclusive jurisdiction
of Irish courts. Consumers may also use the EU Online Dispute Resolution
platform (https://ec.europa.eu/odr).
12. Miscellaneous
12.1. Severability: If any provision of these Terms
is found invalid, the remaining provisions remain enforceable.
12.2. Waiver: Failure to enforce any term does not constitute a waiver
of that term.
12.3. Assignment: The Licensor may assign its rights and obligations to
a third party. Clients and Participants may not assign their rights without
consent.
12.4. Entire Agreement: These Terms, along with any specific agreements,
constitute the entire understanding between the parties.
